this scan was made with a brand new shirt and I had to clean up alot of "noise" in the scan....but here is is full size....remember this is a scan from a shirt....it is a bit difficult to get right.

It is still not permitted to use it to make more shirts XD
'Fair use' is for your own use only, so basicly you can order one such a shirt for yourself... and it is still a violation of copyrights (one may not copy a pattern of a product (fe. textile) and use the same pattern, as is, to re-create similar item.
Just that you know XD

1. The door is hung in the wrong direction.
2. The key shape is a Dexter
3. T-shirt designs rarely include copywriter symbols
4. Who would actually holds the copywriter to art
created for the TV show, the motel man productions
or Lion's Gate?

It seems that the original artist would have been paid a commission for the design, and it's no longer in his hands. Whoever commissioned the design (say, the production team) would most likely own it.
Although, it seems that some of you Collectors are pretty close to them. One of you should ask. They'd likely license the image for use, for a fee (either a one-time flat fee, or a per-shirt percentage).

as long as any shirts made are not sold for a profit then no law is broken.
if you sell them for more than it cost to make them then you are breaking copyright law.

I suppose as long as they are not trying to sell the shirts themselves, so you are not preventing them from making sales by providing free ones to people who might otherwise buy them thru legit channels, no copyright law is broken by making non-profit shirts.
The simple "lack of profit" alone is not enough to legalize piracy, however.

Lionsgate has 1.5 billion dollars in assets.
I don't think the Lost Room is high on their list
of merchandizing revenue streams.
